Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and PageFusion ("we," "our," or "us") governing your use of our products, services, and website (collectively, the "Services").

BY CLICKING "I AGREE," REGISTERING FOR AN ACCOUNT, OR ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT ACCESS OR USE THE SERVICES.

If you are accepting these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

1. Our Services

PageFusion provides a visual page builder platform for Shopify stores. Our Services enable users to create, design, and publish custom landing pages, product pages, and other web pages directly to their Shopify stores using drag-and-drop functionality, templates, and AI-powered generation tools.

2. Account Registration

To use our Services, you must register and create an account ("Account"). When creating an Account, you agree to:

• Provide true, accurate, current, and complete information as prompted by the registration process
• Maintain and promptly update your Account information to keep it accurate, current, and complete
• Maintain the confidentiality of your login credentials and Account information
• Accept responsibility for all activities that occur under your Account
• Notify us immediately of any unauthorized use of your Account or any other breach of security

You are the sole authorized user of your Account. Your Account is not transferable to any other person or entity. We reserve the right to refuse registration or cancel an Account at our sole discretion.

3. Shopify Integration

Our Services integrate with Shopify to enable you to publish pages directly to your Shopify store. By connecting your Shopify store to our Services, you:

• Authorize us to access your Shopify store data necessary to provide the Services
• Represent that you have the authority to connect the Shopify store to our Services
• Agree to comply with Shopify's Terms of Service and applicable policies
• Acknowledge that we are not responsible for any issues arising from Shopify's platform or services

We may access, store, and use information from your Shopify store as necessary to provide, maintain, and improve our Services.

4. Billing and Payment

Subscriptions

Some features of our Services are billed on a subscription basis ("Subscription"). You will be billed in advance on a recurring basis ("Billing Cycle"), either monthly or annually, depending on the plan you select.

• Your Subscription will automatically renew at the end of each Billing Cycle unless you cancel it before the renewal date
• You may cancel your Subscription at any time through your Account settings or by contacting us
• A valid payment method is required to process payment for your Subscription
• By providing payment information, you authorize us to charge all Subscription fees to your payment method

Free Trial

We may offer a free trial for a limited period. If you provide billing information during sign-up, you will be automatically charged the applicable Subscription fee at the end of the free trial period unless you cancel before the trial ends.

Fee Changes

We may modify Subscription fees at any time. Fee changes will become effective at the end of your current Billing Cycle. We will provide reasonable notice of any fee changes to give you an opportunity to cancel before the change takes effect.

Refunds

Except when required by law, paid Subscription fees are non-refundable. If you believe you are entitled to a refund, please contact us at page.fusion.app@gmail.com.

5. User Content

"User Content" means any content, materials, or information that you upload, submit, or make available through our Services, including but not limited to text, images, graphics, designs, and page layouts.

You retain ownership of your User Content. By making User Content available through the Services, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute, and display your User Content solely for the purpose of providing and improving the Services.

You represent and warrant that your User Content:

• Does not infringe any third-party intellectual property rights
• Does not violate any applicable laws or regulations
• Is not false, misleading, defamatory, or fraudulent
• Does not contain malicious code, viruses, or harmful content
• Does not contain content that is obscene, offensive, or harmful to minors

6. Acceptable Use

You agree not to engage in any of the following prohibited activities:

• Copying, distributing, or disclosing any part of the Services without authorization
• Using automated systems (bots, scrapers, etc.) to access the Services without permission
• Attempting to interfere with or compromise the security or integrity of the Services
• Violating any applicable laws, regulations, or third-party rights
• Impersonating any person or entity or misrepresenting your affiliation
• Harassing, threatening, or abusing other users or our staff
• Uploading viruses, malware, or other malicious code
• Attempting to reverse engineer, decompile, or disassemble the Services
• Using the Services to send spam or unsolicited communications
• Accessing or attempting to access accounts or data belonging to others

The Services, including all content, features, functionality, software, text, graphics, logos, and trademarks, are owned by PageFusion or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes.

You may not copy, modify, distribute, sell, or lease any part of the Services, nor may you reverse engineer or attempt to extract the source code of the Services, unless laws prohibit these restrictions or you have our written permission.

If you provide us with any feedback, suggestions, or ideas about the Services ("Feedback"), you grant us the right to use such Feedback without restriction and without compensation to you. You acknowledge that we may have similar ideas or Feedback already under consideration or development.

9. Third-Party Services

The Services may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is at your own risk and subject to the terms and privacy policies of those services.

We may allow you to connect your Account with third-party accounts (such as Google for authentication). By connecting a third-party account, you authorize us to access certain information from that account as permitted by your settings and the third-party's terms.

You agree to indemnify, defend, and hold harmless PageFusion and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) your violation of any applicable laws or regulations.

Either party may terminate these Terms at any time for any reason. You may cancel your Account by using the features in your Account settings or by contacting us at page.fusion.app@gmail.com.

We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, breach of these Terms, suspected fraudulent or illegal activity, or extended periods of inactivity.

Upon termination, your right to use the Services will immediately cease. We may delete your Account and all associated data in the normal course of operations. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Dispute Resolution

Informal Resolution

Before filing any formal dispute, you agree to first contact us at page.fusion.app@gmail.com and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations for at least 30 days before either party may initiate formal proceedings.

Binding Arbitration

If we cannot resolve the dispute informally, you and PageFusion agree that any dispute arising out of or relating to these Terms or the Services will be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights. By agreeing to these Terms, you waive your right to a jury trial.

Class Action Waiver

You agree that any disputes will be resolved on an individual basis and not in a class, consolidated, or representative action. You waive the right to participate as a plaintiff or class member in any class action proceeding.

15. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on our Services prior to the changes taking effect. Your continued use of the Services after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Services.

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PageFusion regarding the Services.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
• No Agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and PageFusion.
• Notices: We may provide notices to you by email, posting on the Services, or other reasonable means. You consent to receiving electronic communications from us.
